Kerry Finley joined Simmons Perrine Moyer Bergman PLC in 2006. She previously was a partner with Finley, Alt, Smith in Des Moines where she specialized in professional and corporate defense. At the beginning of her career, Kerry was associated with Willkie Farr & Gallagher in New York City as a litigator in its business reorganization group.

 

Appellate Advocacy and Trial Support. Ms. Finley has appeared numerous times before the Iowa Supreme Court and the Iowa Court of Appeals in several kinds of cases including: medical malpractice; legal malpractice; professional negligence; commercial disputes; premises liability; products liability; dissolutions and criminal matters. Ms. Finley also assists the firm’s trial attorneys in a variety of ways including error preservation and the identification, research, framing and argument of legal issues.

 

Professional Negligence. Ms. Finley has defended physicians and other medical professionals in medical malpractice actions. She has represented several attorneys in legal malpractice actions. Ms Finley has served as outside counsel for several Iowa hospitals in a variety of contexts, including: professional negligence; premises liability; professional staff issues; contract preparation and disputes regarding independent contractors; and Joint Commission, HIPAA, Medicare and Medicaid compliance issues. She has also represented physicians, attorneys, dentists and engineers in administrative proceedings before their respective licensing boards.

 

Ms. Finley grew up in Des Moines. She is the former owner of Docks Restaurant in Clear Lake. She currently lives in Iowa City with her two children.

Len Strand and Kerry Finley Obtain Favorable Iowa Supreme Court Ruling for Client

On Friday, November 13, 2009, the Iowa Supreme Court upheld a summary judgment ruling in favor of the firm's client and another defendant, concluding that owners of property did not owe a duty to warn the spouse of an independent contractor of the health hazards posed by asbestos. Len Strand and Kerry Finley defended the case and presented the arguments on appeal. The case is Van Fossen v. MidAmerican Energy Co. and Interstate Power and Light Co., No. 06–1691 (Iowa Nov. 13, 2009).
