Kevin Visser tries cases to judges and juries, in the state and federal courts. The public record of the roughly two dozen appeals (mostly federal) taken from trial court decisions reflects the varied nature of those Mr. Visser represents (closely and publicly held corporations and their shareholders, individual citizens (and non-citizens), and corporate officers) and the subject matters of their litigation (business torts, business competition issues, employment discrimination, contracts, and labor law). His trial and appellate experience is most often used, however, to aid clients in finding mediated or negotiated settlements of their disputes. Mr. Visser has been asked to serve and has served, as a mediator, arbitrator, and administrative law judge.
Mr. Visser is the firm’s Primary Contact with the USLaw Network and has served on the firm’s management committee. His professional affiliations include the American and Iowa State Bar Associations, the AGC Labor Lawyers’ Council, and the American Board of Trial Advocates. Mr. Visser is a Fellow of the Iowa Academy of Trial Lawyers and an active member of the Mason Ladd Inn of Court. He regularly speaks to public and private groups, primarily on topics related to trial practice or employment law. Peer recognition is reflected in Mr. Visser’s Martindale Hubbell “av” rating (very high to pre-eminent); his citation in Chambers USA’s Leading Lawyers for Business; and the “Super Lawyer” status conferred by the publication of the same name.
Mr. Visser is admitted to practice before the Iowa and United States Supreme Courts, the Eighth Circuit Court of Appeals, and the United States District Courts in Iowa. (He has appeared elsewhere often by pro hac vice admission.) Mr. Visser took his undergraduate degree in economics, where his work was recognized, prior to completing the University of Iowa’s Accelerated Program in 1980. Wednesday, April 14, 2010 Iris Muchmore and Kevin Visser Speak at Employment Seminar On April 9, 2010, Iris Muchmore and Kevin Visser made presentations as part of the Iowa Defense Counsel Association's spring seminar, titled "Current Developments in Employment Law." Iris spoke on "New Developments under the Family and Medical Leave Act." Kevin's topic was "Current Developments in Federal Employment Litigation."
Saturday, August 15, 2009 Federal Judge Dismisses Entire ‘Class’ Claim of EEOC Chief Judge Linda Reade has entered the final judgment in a series of rulings against the EEOC in a massive but “untenable” case it brought against the privately held national trucking firm, CRST Van Expedited, headquartered in Cedar Rapids. Simmons Perrine Moyer Bergman and the Chicago firm Jenner & Block LLP represented CRST in the case.
Other, like cases brought by the EEOC have languished in federal courts for years, with very few, if any, having actually been brought to trial or summary dismissal. The court criticized the EEOC’s “sue first, ask questions later” litigation strategy, observing, “The government, like its citizens, must follow the law.” This order follows earlier orders: 1) granting summary judgment to CRST in determining that no reasonable jury could conclude that CRST tolerated a "pattern or practice" of sex harassment as part of its "standard operating procedure"; 2) dismissing more than 100 prospective claimants as a discovery sanction against the EEOC for its failure to make the women available for depositions; 3) granting summary judgment to the employer on nearly 90 individual claims as the claimed conduct failed to rise to the level actionable by law; and 4) dismissing several claims because of inconsistent statements made by claimants in bankruptcy. At least seven SPMB attorneys were called upon to depose claimants across the country beginning in 2008 when the government provided CRST “a continuously moving target” of the number of claimants involved. Thursday, June 04, 2009 Simmons Perrine Moyer Bergman to Hold Labor and Employment Law Seminar June 16 and 18 Simmons Perrine Moyer Bergman will conduct a client seminar on labor and employment law on Tuesday, June 16, and Thursday, June 18. The June 16 seminar will be at the Cedar Rapids Country Club. The June 18 seminar will be at the Kinnick Stadium Press Box in Iowa City. The program will start at 1:30 and will end in time for a reception at 4:30. The seminar will cover many topics, including using e-verify to quell immigration concerns and changes in the FMLA and ADA.
