Louis E. Ebinger is an associate of Simmons Perrine Moyer Bergman PLC engaged primarily in a general practice, including but not limited to, Bankruptcy Law, Commercial Law, Debtor and Creditor, Real Estate, Contracts and Nonprofit Law.
Corporate Transactions & Business Counseling. Mr. Ebinger advises clients regarding selection and structure of the proper business entity such as a proprietorship, partnership, limited liability company, or corporation. He also assists in the purchase or sale of a business, arrangement of financing, and the negotiation and preparation of various business documents, including operating agreements, contracts, articles of incorporation, bylaws, and governmental filings.
Finance & Financial Institutions. Mr. Ebinger represents various financial institutions including banks, credit unions, and other financial institutions which are headquartered in Cedar Rapids or surrounding communities. He counsels financial institutions with respect to the organization and structure of the institution, regulatory compliance, loan transactions, forms, loan collections, foreclosures and related matters.
Real Estate. Mr. Ebinger counsels clients on matters including planning and drafting documentation in the acquisition or disposition of properties, leasing, development of condominium projects, platting, zoning, property tax assessment matters, condemnations, and various construction projects.
Bankruptcy Litigation. Mr. Ebinger represents clients in Chapter 7 liquidations, Chapter 11 reorganizations and Chapter 13 proceedings.

Tuesday, November 10, 2009 Lou Ebinger Authors Article on FTC's Red Flags Rule The Edge Business Magazine published an article in its November 2009 issue by Lou Ebinger titled "The FTC’s red flags rule: Are you in compliance?" The rule, which was to have gone into effect November 1, 2009, requires certain businesses and organizations to develop a written program to spot the warning signs of identity theft and respond appropriately. Subsequent to the article, the FTC announced a delay in the enforcement of the rule until June 1, 2010.
Monday, July 27, 2009 Lou Ebinger Elected Vice President of Linn Law Club At its annual officer elections meeting on July 16, Lou Ebinger was elected Vice President of the Linn Law Club, the young lawyers division of the Linn County Bar Association. His term will last one year. Tim Van Pelt just completed a term as President of the Linn Law Club.
Tuesday, May 05, 2009 Edge Business Magazine Publishes Article by Lou Ebinger on Challenges Banks Face in Serving Underbanked Customers The Edge Business Magazine published an article by Louis E. Ebinger in its May 2009 issue entitled “Serving the underbanked is bigger challenge today.” The article discussed a recently reported survey by the FDIC on banks’ efforts to serve the unbanked and underbanked. The article discussed hurdles to serving the underbanked and strategies for expanding services provided by banks.
Thursday, April 02, 2009 Firm Attorneys Present Seminar on Banking Issues On April 2, Eric Lam, Lynn Hartman, Jason Steffens, Abbe Stensland, and Lou Ebinger presented a client seminar for banking clients addressing a number of issues.
Eric provided an update on bankruptcy laws and the Uniform Commercial Code, including potential changes to chapter 13 bankruptcies.
Lynn discussed foreclosure options for lenders and recent changes to Iowa foreclosure laws.
Jason spoke on allocation of liability in check fraud issues. He also addressed the retention and destruction of electronically stored information.
Abbe outlined a creditor's ability to utilize Iowa's small claims court procedures.
Lou discussed procedures for properly documenting collateral for secured loans.
