Jason Steffens Re-Appointed to Boys & Girls Club of Cedar Rapids Executive Committee
Jason M. Steffens was elected Secretary of the Board of Directors of the Boys & Girls Club of Cedar Rapids at the Board's annual meeting on June 22, 2009. As Secretary, he will serve on the Executive Committee of the Board. Jason's term as Secretary will last one year. He previously served as Treasurer. The mission of the Boys & Girls Club of Cedar Rapids is to inspire and enable all young people, especially those that need us most, to realize their full potential as productive, responsible and caring citizens.
Matt Hektoen to Represent the Young Lawyers Division of the ISBA at Annual ABA Meeting
Matthew J. Hektoen will travel to Chicago from July 30-August 2 to attend the 2009 American Bar Association Annual Meeting. On behalf the Legislative Leadership Academy Committee of the Young Lawyers Division of the Iowa State Bar Association, Matt recently successfully applied for a Subgrant. The Legislative Leadership Academy Committee is charged with increasing the participation of lawyers in the legislative process in the State of Iowa. The Subgrant funds will be utilized to help fulfill this charge. Matt will accept the Subgrant award at the ABA Young Lawyers Division Annual Session.

Subgrants are awarded annually by the American Bar Association Young Lawyers Division (ABA YLD), with support from the ABA Fund for Justice and Education. The program is designed to promote quality projects developed by affiliated young lawyer organizations and to assist in the success of the program by providing support through program funding member service projects.
Susan Willey on Panel to Discuss the Stimulus Bill's Impact on the Bond Market
Susan H. Willey will be participating in a roundtable discussion addressing the impact of the American Recovery and Reinvestment Act of 2009 (the Stimulus bill) on the bond market. She will outline the major spending initiatives that affect the construction industry. Other panel members will address the impact of the new law on construction bonding requirements. The program is June 26, 2009 from 11:00 a.m. to 1:00 p.m. The discussion is sponsored by True North.
Kerry Finley Elected to LCBA Board of Governors
At the Linn County Bar Association's annual meeting on June 16, Kerry A. Finley was elected to the Board of Governors. The Board of Governors is the managing board of the LCBA. Kerry will serve a three-year term.
Christine Conover Assists with IDCA Trial Academy on Voir Dire
Christine Conover assisted with organizing the Iowa Defense Counsel Association's Mini-Trial Academy on Voir Dire June 4-5, 2009, at the Neal and Bea Smith Legal Clinic at Drake University in Des Moines. The continuing education seminar featured jury consultant Rob Conklin and a number of experienced litigators demonstrating techniques for voir dire and jury selection with a mock jury. In addition, participants had a "hands-on" learning experience by practicing their own voir dire exercises with mock jurors and receiving feedback from experienced trial attorneys.
Len Strand Elected to YMCA Board
Len Strand has been elected to a three-year term on the Board of Directors of the YMCA of the Cedar Rapids Metropolitan Area. The organization operates the three YMCA branches in the Cedar Rapids area, along with Camp Wapsie, near Coggon, and is an affiliate of the YMCA of the USA.
Simmons Perrine Moyer Bergman Legal Assistant Featured in USA Today for Cloud Photograph
Today's edition of USA Today included an article about a photograph Simmons Perrine Moyer Bergman legal assistant Jane Wiggins took in 2006. Scientists are investigating whether the photograph depicts a new cloud type. It would be the first new cloud type recognized since 1951. Jane took the photograph from the firm's downtown Cedar Rapids office building.
Paul Morf "Off to England" to Represent Cedar Rapids Rotary Club
Paul Morf will be sworn in as the new President of the Cedar Rapids Rotary Club on June 15, 2009. His first act as President will be to represent the club at the Rotary International Convention in Birmingham, England, beginning on June 20. The Cedar Rapids Rotary Club is the largest club in District 5970, with roughly 300 active members.
Jason Steffens and Kyle Wilcox to Present at Probate Law Seminar
Jason Steffens and Kyle Wilcox will be among the presenters at a one-day seminar on the “Oddities and Challenges in Probate Law.” The seminar will take place on June 30 in Cedar Rapids. It is sponsored by the National Business Institute. Kyle will present on personal representative challenges and distribution of personal property. Simmons Perrine Moyer Bergman to Hold Labor and Employment Law Seminar June 16 and 18
Simmons Perrine Moyer Bergman will conduct a client seminar on labor and employment law on Tuesday, June 16, and Thursday, June 18. The June 16 seminar will be at the Cedar Rapids Country Club. The June 18 seminar will be at the Kinnick Stadium Press Box in Iowa City. The program will start at 1:30 and will end in time for a reception at 4:30. The seminar will cover many topics, including using e-verify to quell immigration concerns and changes in the FMLA and ADA. Phil Burian Receives Favorable Results in Two Recent Trials
Philip A. Burian has recently received two favorable trial results. Earlier this year, Phil represented an insurance company suing another insurance company for contribution based on settlement of an underlying personal injury lawsuit. The insurer defending against the case claimed that the individual who caused the accident was not an insured based on policy language defining "an insured" and based on an exclusion to the policy. Phil persuaded the court in a bench trial that the other carrier was misapplying its own policy and received a complete ruling in his client's favor.
br>Just last month, Phil defended an individual in a defamation action brought by a former city manager. The plaintiff claimed that statements made before a city council meeting ultimately caused the plaintiff to be fired and suffer injury to his reputation in the community. The plaintiff claimed in excess of $2.5 million. After a two week trial that often focused on First Amendment protections for speech relating to public officials and matters of public concern, the jury returned a verdict completely in Phil's client's favor.
Christine Conover Elected President-Elect of Iowa Society of Healthcare Attorneys
On May 12, 2009, Christine L. Conover was elected President-Elect of the Iowa Society of Healthcare Attorneys (ISHA). She has previously served as Vice President and as Secretary of ISHA.

The Iowa Society of Healthcare Attorneys is an affiliate group of the Iowa Hospital Association. Membership is limited to attorneys who represent or are employed by a health care institution or organization that holds membership in the Iowa Hospital Association, or who represent a provider who holds privileges at such health care institutions or organizations. The Iowa Hospital Association's mission is to represent Iowa hospitals and support them in achieving their missions and goals.
Phil Brooks Highlighted in Spring Newsletter of Vaughan Institute of Risk Management and Insurance
The Spring 2009 newsletter of the Vaughan Institute of Risk Management and Insurance highlighted Philip D. Brooks in an article titled "Phil Brooks Relishes Resources and Relationships." The Vaughan Institute of Risk Management and Insurance is part of the Tippie College of Business at the University of Iowa. Phil taught at the University of Iowa's College of Business from 1977 to 1983 and has served as an adjunct instructor at the Institute since 2005.
Lynn Hartman Presents at USLAW 2009 Women's Weekend
On May 2, 2009, Lynn Hartman presented on insolvency and bankrupcty issues at the USLAW Network's 2009 Women's Weekend in Las Colinas, Texas. The presentation focused on the automatic stay in bankruptcy, Bankruptcy Code section 525, judicial estoppel in bankruptcy, special trustee considerations, procedures for purchase money security interests, letters of credit, and guaranties.
Edge Business Magazine Publishes Article by Lou Ebinger on Challenges Banks Face in Serving Underbanked Customers
The Edge Business Magazine published an article by Louis E. Ebinger in its May 2009 issue entitled “Serving the underbanked is bigger challenge today.” The article discussed a recently reported survey by the FDIC on banks’ efforts to serve the unbanked and underbanked. The article discussed hurdles to serving the underbanked and strategies for expanding services provided by banks.
Kathleen Kleiman Appointed Secretary of Miracles in Motion Board
Kathleen A. Kleiman has been appointed Secretary of the Board of Directors of Miracles in Motion. Her term runs through December 2009. Miracles in Motion's mission is to "foster personal achievement by providing diverse equestrian activities with therapeutic, educational and recreational benefits for persons with disabilities."
Scott Bogguss Appointed Chair of ISBA Tax Section
J. Scott Bogguss has been appointed to serve as Chair of the Iowa State Bar Association Tax Section for the upcoming fiscal year July 1, 2009 to June 30, 2010.

The Tax Section sponsors the Bloethe Tax School each December, which is commonly attended by several hundred lawyers from all over Iowa. The section also sponsors the Spring Tax Institute each May and participates in the ISBA’s activities regarding legislative assistance in federal and state tax matters affecting all Iowans.
Iowa Lawyer Magazine Features the Firm's Merger
The Iowa Lawyer, the monthly publication of the Iowa State Bar Association, featured Simmons Perrine Moyer Bergman in its April 2009 cover story on law firm mergers. The article discussed the benefits to clients and similarities in the firm cultures of Simmons Perrine and Moyer & Bergman as reasons for the merger. The article quoted Randy Scholer as saying, "In the 27 years I've been practicing, there has been a huge move to specialization. This way we can devote 5-6 attorneys to a particular matter without neglecting other clients. I have 57 other attorneys I can rely on to help clients who may have the need for help in a specific area of law."
Susan Willey Presents Program on Tax Changes in Stimulus Package
Susan H. Willey is presenting a program for the Greater Iowa City Homebuilders Association entitled “Tax Changes in the Stimulus Package – will they grow your Business?” Her presentation is scheduled from 12:00 to 1:00 p.m. on April 9, 2009. Her talk will focus on the recent tax changes in the American Recovery and Reinvestment Act of 2009 that benefit the construction industry. Later in the month, she will address the Cedar Rapids Homebuilders’ Association on the same topic. This discussion will take place on April 20th at the Embassy Club, El Kahir Shrine Temple in Cedar Rapids from 12:00 to 1:00. She was recently interviewed by the Cedar Rapids Gazette on the changes to the First-Time Homebuyers’ Credit at the request of the Greater Iowa City Homebuilders to help inform prospective buyers about the benefits of the credit.
Dave Kubicek Attends Mid-Year Meeting of American College of Real Estate Lawyers
David W. Kubicek recently returned from a mid-year meeting of the American College of Real Estate Lawyers ("ACREL") in Puerto Rico. Topics discussed at the meeting included wind leases, commercial lease issues in troubled times and title insurance issues, all areas of interest to Dave. The program included a presentation, with an emphasis on commercial real estate, by a representative of the Federal Reserve Bank of Richmond.
