Steve Holtman and Jason Steffens obtain appeal victory

On November 24, 2010, the Iowa Court of Appeals ruled in favor of the firm's client, Qwest, affirming the district court's dismissal of a lawsuit seeking to enforce an alleged settlement agreement. The court granted the dismissal on grounds of claim preclusion and issue preclusion. Steve Holtman and Jason Steffens briefed the issues before the trial and appellate courts and Steve Holtman presented the oral argument on appeal. The case is Lawchek, Ltd. et al v. Qwest Communications Federal Services, Inc., No. 0-648 / 10-0519.

Steve Holtman Obtains Victory in Dealership Termination Case

On March 4, 2010, following an April 2009 trial to the court and significant post-trial briefing, the Iowa District Court for Fayette County entered judgment in favor of the firm's client, a defendant in an agricultural equipment dealership termination case. The plaintiff, a former dealer of the firm's manufacturing client, sought $4.8 million in damages under Iowa Code chapter 322F. The court ruled that the plaintiff was not entitled to its claimed damages under that chapter. The court had previously dismissed the plaintiff's other claims on summary judgment. In its March 4 order, the court also noted that the plaintiff's damages expert "was subject to a very thorough and damaging cross-examination," such that his testimony was not convincing. Steve Holtman represented the defendant manufacturer for the firm.

Steve Holtman and Jason Steffens Obtain Trial Victory in a Dispute Over a Shareholders' Agreement

On July 29, 2009, the Linn County District Court entered a ruling and judgment in favor of the firm's client in an action to enforce a stock purchase agreement among the shareholders of a closely-held corporation. Steve Holtman and Jason Steffens had tried the case on behalf of the shareholder seeking to purchase the stock following the death of another shareholder. Steve and Jason successfully argued that the purchase price of the stock was approximately $1.1 million. The selling shareholder's Estate made a number of arguments to increase the price to approximately $3.5 million. The court ruled in favor of the firm's client on each of the arguments designed to increase the purchase price.
